PARTIES INVOLVED

On the one part, and acting in their own name, THE USER, with address and ID/DNI provided by the User and incorporated into the database of a file for which Bodegas Franco Españolas is responsible, is subject to the provisions of current regulations on personal data protection. By accepting the Privacy Policy, the User acknowledges having been duly informed regarding data protection.

And on the other part, Bodegas Franco Españolas Vino y Experiencias SLU, with CIF B26112714 and registered office at Calle Cabo Noval 2, Logroño, hereinafter, the Winery. Both parties mutually recognize each other’s legal capacity required to formalize this contract, in accordance with the following

GENERAL TERMS AND CONDITIONS

1. The Agreement: These General Conditions shall apply to all products offered by Bodegas Franco Españolas, as well as to the deliveries of goods and services marketed by Bodegas Franco Españolas on the tour portal https://www.francoespanolas.com/visitas/ These General Conditions shall be in force for all goods and services offered and may be modified without prior notice, although changes will not affect purchases already made up to that point.

2. Formalization of the Purchase: The purchase of the products offered on the website is carried out by selecting the chosen products, which will be included in the shopping cart. Once the selection is completed, the purchase will continue by filling in personal details (depending on each case) for the issuance of the invoice, and credit card details to make the payment for the products. Finally accepting the purchase made, the definitive purchase of the selected products will be carried out, and the payment method (Credit Card or Paypal) will be selected.

3. Intellectual Property: Bodegas Franco Españolas authorizes the use of its trademarks exclusively under the terms agreed in these General Terms and Conditions. In no case shall it be understood that any license is granted or that any waiver, transmission, total or partial assignment of said rights is made, nor is any right or expectation of a right conferred, and in
particular, of alteration, exploitation, reproduction, distribution, or public communication of said content without the prior express authorization of Bodegas Franco Españolas.

In the event that the Buyer/User becomes aware of unauthorized uses by third parties, they shall inform Bodegas Franco Españolas as soon as possible so that it can adopt the measures it deems appropriate.

4. Applicable Law and Jurisdiction: This Contract and all documents attached hereto shall be governed by and construed in accordance with Spanish Law. In the event of a dispute between the parties regarding this Contract, the parties agree, waiving their own jurisdiction if any, to expressly submit to the jurisdiction of the Courts and Tribunals of Logroño (La Rioja).

HOW TO USE OUR ONLINE TOUR SYSTEM

How do I request a tour?

Select the type of tour you wish to take. The system will show you a calendar to choose the day of your tour, language, and number of people coming, including children.

Can I cancel the date of a tour once the reservation has been made?

You can cancel according to the period specified in the general conditions that appear before the purchase operation, as each activity has different conditions. You must access the “Your tours” section and, from the “cancel” option, enter the booking reference and the date for which you have the reservation. Refunds are generally made instantly. No changes or cancellations are allowed for tickets to cultural activities such as theater, cinema, concerts, etc.

Purchase conditions for “Regala”

Users may purchase their gifts in advance in accordance with the instructions indicated on the website. The purchase of “Regala” (Gift vouchers) is subject to the right of NON-withdrawal. No changes or refunds are allowed on the purchase. The period to redeem a “Regala” voucher is 12 calendar months from the date of purchase. However, should Bodegas Franco Españolas fail to provide the service, a full or partial refund of the amount paid for the purchase will be made, in the event that booking at the Winery is not possible within the periods initially planned. All this without prejudice to any claims that may be appropriate in accordance with applicable civil and commercial regulations.

Can I request an invoice for my purchase?

Yes, you must access the “Your tours” section, select the option to request an invoice, and enter your booking reference. Once requested, you can download it from the Request Invoice section after the tour has taken place. For other services, contact: visitas@francoespanolas.com

HOW TO USE THE ONLINE GASTROBAR

How do I place an order?

Our Online Gastrobar service is only available for private and previously announced events. Orders to be served outside of our Winery are not accepted. To activate it, you just have to scan the QR code associated with your table with your mobile phone. Once the payment process is completed, our team will deliver the requested products to you.

Do I have to fill in my details every time I place an order?

No, only the first time. Once the first order has been placed, the system remembers your details to facilitate the process.

Can I cancel a requested service?

No, cancellations are not allowed.

Can I modify a requested service?

No, modifications are not allowed.

What happens if we cannot serve your complete order due to lack of stock?

We will refund the unserved amount to your credit card immediately.

Can I request an invoice for my purchase?

Yes, send an email to visitas@francoespanolas.com with the booking reference number provided in the order confirmation email, along with all fiscal details. We will send you the invoice in PDF format.
